ah44's total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed the total amount deposited by you into your ah44 account in the thirty (30) days immediately preceding the event giving rise to the claim.
ah44 does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. The Platform is provided on an "as is" and "as available" basis. ah44 makes no representations or warranties of any kind, express or implied, regarding the operation of the Platform or the information, content, or materials included therein.
Nothing in these Terms shall limit or exclude ah44's liability for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
ah44 collects, processes, and stores personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy.
ah44 implements appropriate technical and organizational measures to protect your personal data against unauthorized access, disclosure, alteration, or destruction. Upon account closure, any remaining balance (after deduction of applicable fees and any amounts subject to investigation) will be returned to you via your verified payment method, subject to completion of any outstanding KYC requirements.
Where an account is terminated due to a breach of these Terms, ah44 reserves the right to forfeit any remaining balance in accordance with applicable law and regulatory requirements.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
In the event of a dispute between you and ah44, we encourage you to contact our customer support team in the first instance to seek an amicable resolution. ah44 is committed to resolving player complaints fairly and promptly.
If a dispute cannot be resolved through our internal complaints process, you may escalate the matter to PAGCOR or such other regulatory authority as may have jurisdiction over the matter. The courts of the Philippines shall have exclusive jurisdiction over any dispute that cannot be resolved through the foregoing processes.
Any claim arising out of or relating to these Terms must be brought within one (1) year of the date on which the cause of action arose, or such claim shall be permanently barred.
